You further agree when you communicate or engage with Holloway Credit Solutions, LLC through this portal, by text, or by email, you consent to receive an immediate, automated electronic response from Holloway Credit Solutions, LLC by text or email regardless of the time of day, day of week, or frequency of the communications.

You understand you have the following rights:

• To receive this information in paper form at no charge by calling us at 800-206-3073 during normal business hours of Monday - Friday, 7AM - 6PM CST or by sending us a written request for this information at PO Box 230609, Montgomery AL 36123.
• To withdraw your consent to this Communication Agreement at any time by calling us at 800-206-3073 during normal business hours of Monday - Friday, 7AM - 6PM CST or by visiting this website at evokepay.com/hcs/login and changing your Communication Preferences. That upon withdrawing consent to this Communication Agreement, we will no longer send you notices, disclosures, and legal documents electronically about any Active Accounts placed with our agency for collection now or in the future without first obtaining your consent. We will instead send this information to you by U.S. first class mail.
• To update your email address or mobile phone number by calling us at 800-206-3073 during normal business hours of Monday - Friday, 7AM - 6PM CST or by visiting this website at evokepay.com/hcs/login and changing your Communication Preferences.
• To receive notices, disclosures, and legal documents electronically according to the terms of this Communication Agreement, you must be able to access the email address and/or mobile phone number you provided us for this purpose and access and retain any information that we may send you at this address or phone number in connection with the collection of Active Accounts now or in the future including the email or text messages sent to you, hyperlinks, URL addresses, or attachments.
• To demonstrate you are able to access notices, disclosures, and legal documents we send you, and before this Communication Agreement takes effect, you must complete the verification steps we require for electronic Communication Preferences.

By checking the box next to each form of communication, you are confirming you understand and agree you are providing Holloway Credit Solutions, LLC and its affiliates, agents, and service providers with your express consent to access information we use in connection with the collection of an Active Account now or in the future and to use written, electronic, or verbal means to contact you including but not limited to: contact by phone by using a dialer, contact by phone by using a manual contact system, contact by phone by using text messaging, contact by email, contact by using an artificial voice, or contact by leaving a prerecorded message to a mobile phone or land line. This is a communication from a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.

For residents of Hawaii and Vermont, this is an attempt to collect a claim and any information obtained will be used for that purpose.

OPTIONAL PROVISION: Holloway Credit Solutions, LLC is a licensed collection agency. For purposes of this agreement and text message communications we will always refer to our company as HCS.

By subscribing to Holloway Credit Solutions, LLC’s Text Message Service you agree to the following Terms and Conditions:

Mobile Phone Ownership and Mobile Number: When you subscribe to Holloway Credit Solutions, LLC’s text message service you are confirming the mobile phone number you use to subscribe is the mobile number associated with your mobile phone. You and no other person will use this mobile phone to communicate with Holloway Credit Solutions, LLC about your account(s). Throughout this agreement the word “you” includes the person associated with the mobile phone and mobile number you use to subscribe to this text message service.

Agreement: This Terms and Conditions document is an agreement between you and Holloway Credit Solutions, LLC which explains some of your important rights under the law, how the text message service works, how text fees and data rates may apply, how you may access information, when we may initiate text messages to the mobile phone number you used to subscribe, your agreement to receive text messages and other important features associated with the text message service. To agree to these Terms and Conditions choose Text as Your communication preference from the Payment Portal and respond to the text received from Holloway Credit Solutions, LLC to verify your account.

If you delete your text messaging history from your mobile phone you may lose information about this text message service. To retrieve the Terms and Conditions you can go to evokepay.com/hcs/login.

Voluntary Participation: Holloway Credit Solutions, LLC is a third-party debt collector and offers this text message service to you in connection with the collection of debt. This is a voluntary service you may start or stop at any time.

Purpose: The purpose of this text message service is to allow you to obtain information about your account(s) associated with this mobile phone number by communicating via text with Holloway Credit Solutions, LLC.

Accounts: This text message service allows you and this Holloway Credit Solutions, LLC to communicate about any accounts associated with the mobile phone number you provide when selecting to communicate via text message. Accounts placed with us for collection by more than one business may be excluded from this text message service and Accounts placed with us that are closed, inactive, subject to a cease communication, communication restrictions or otherwise prohibited from collection activity will be excluded from this text message service.

Communication Agreement: By agreeing to the Communication Agreement in the Payment Portal, you consent to the terms as presented and further agree:

• Holloway Credit Solutions, LLC may send limited types of text messages to you about Account(s);
• You may obtain additional information about your Account(s) by visiting Holloway Credit Solutions, LLC’s Payment Portal at evokepay.com/hcs/login;
• When you interact with the Payment Portal, you may receive an immediate, automated response from Holloway Credit Solutions, LLC regardless of the time of day, day of week or frequency of the communications; and
• Text messages sent to you by Holloway Credit Solutions, LLC may appear on the face of your mobile phone or device and you will manage the settings associated with how text messages are displayed on your phone or device to protect your confidential information.

Text Message Service Termination Process: To terminate participation or unsubscribe from Holloway Credit Solutions, LLC’s text message service, you need to text the word ALTO, STOP, STOP!, STOPNOW, STOPALL, END, QUIT, QUITNOW, CANCEL, CANCELAR, NOMO, UNSUBSCRIBE, REMOVE, OPTOUT, PARA, PARAR, PARE, or ARRET to Holloway Credit Solutions, LLC’s text number. You may also unsubscribe by visiting the Payment Portal at evokepay.com/hcs/login and deselecting text as a Communication Preference.

Translation of Abbreviations: Holloway Credit Solutions, LLC’s text message service uses abbreviations when communicating with you. Please refer to this abbreviation translation list or contact Holloway Credit Solutions, LLC if you have questions or need assistance.

REMEMBER EACH TEXT RESPONSE FROM Holloway Credit Solutions, LLC IS A COMMUNICATION FROM A DEBT COLLECTOR AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

• Holloway Credit Solutions, LLC Initiated Text Message Service – Holloway Credit Solutions, LLC may at times decide to initiate text messages to the mobile phone number you use to subscribe to its text message service.
• Account Verification – Holloway Credit Solutions, LLC may send you a text message after you enter your email address or phone number in the communication preferences on the Holloway Credit Solutions, LLC Payment Portal. You must click the link to verify your account and receive future notifications.
• Broken Promise – Holloway Credit Solutions, LLC may send you a text message to follow up on an Account where a payment was missed. (Same as Generic Past Due)
• Debt Verification Request – Holloway Credit Solutions, LLC may send you a text message to respond to your request for your Debt Verification Information.
• Declined Payment – Holloway Credit Solutions, LLC may send you a text message based on your Communication Preferences when your payment is declined. (Same as Errored Payment & Failed Payment)
• EFT Notification Letter – Holloway Credit Solutions, LLC may send you a text message to provide you access to your Funds Transfer Notification.
• Electronic Payment Reminder – Holloway Credit Solutions, LLC may send you a text message reminder to notify you of the amount and the date when your authorized electronic payment will be processed. (Same as Scheduled Payment Reminder)
• Errored Payment – Holloway Credit Solutions, LLC may send you a text message based on your Communication Preferences when your payment has errored. (Same as Declined Payment & Failed Payment)
• E-Statement/Document Notification – Holloway Credit Solutions, LLC may send you a text message when you have opted in for electronic delivery of documents and a new document has been generated for your account.
• E-Statement/Document Enrollment Confirmation – Holloway Credit Solutions, LLC may send you a text message to confirm you have opted in for electronic delivery of your documents.
• E-Statement/Document Unenrollment Confirmation – Holloway Credit Solutions, LLC may send you a text message to confirm that you have opted out of electronic delivery of your documents.
• E-Statement/Document Reminder – Holloway Credit Solutions, LLC may send you a text message to remind you to view an existing document which has not yet been viewed.
• Expired Credit Card – Holloway Credit Solutions, LLC may send you a text message when you have a credit card associated with a payment arrangement and the credit card has expired. The notification is sent on the first day of the month that the card expired.
• Expiring Credit Card – Holloway Credit Solutions, LLC may send you a text message when you have a credit card associated with a payment arrangement and the credit card is about to expire. The notification is sent on the first day of the last month that the card is valid.
• Failed Payment Notification – Holloway Credit Solutions, LLC may send you a text message if your payment did not process due to insufficient funds in the account or another problem which prevented the processing of the payment. (Same as Declined Payment & Errored Payment)
• Generic Past Due – Holloway Credit Solutions, LLC may send you a text message to follow up on an Account where a scheduled payment was missed. (Same as Broken Promise)
• Inactive E-Statement/Document Opt Out – Holloway Credit Solutions, LLC may send you a text message to inform you that due to inactivity in viewing documents, the system will automatically set you back to receiving documents via paper delivery.
• Initial Communication – Holloway Credit Solutions, LLC may send you a text message to inform you that they have received your Account for collection.
• Initial Communication – Validation Information – Holloway Credit Solutions, LLC may send you a text message with access to your Validation Information and inform you that they have received your Account for collection.
• Name of Original Creditor – Holloway Credit Solutions, LLC may send you a text message to respond to your request for the Name of the Original Creditor.
• New Account Notification – Holloway Credit Solutions, LLC may send you a text message to let you know that we have received a new account for you.
• Payment Plan Cancelled – Holloway Credit Solutions, LLC may send you a text message when your payment plan has been cancelled.
• Payment Plan Completed – Holloway Credit Solutions, LLC may send you a text message when the last payment in your payment plan has processed and completes the plan.
• Payment Plan Enrollment – Holloway Credit Solutions, LLC may send you a text message with the details of the payment plan you set up.
• Post Dated Payment Notice – Holloway Credit Solutions, LLC may send you a text message to access your Post-Dated Payment Information.
• Receipt of Payment – Holloway Credit Solutions, LLC may send you a text message to confirm the receipt of your payment.
• Receipt of Payment in Full – Holloway Credit Solutions, LLC may send you a text message to confirm the receipt of your payment in full.
• Receipt of Settlement in Full – Holloway Credit Solutions, LLC may send you a text message to confirm the receipt of your settlement in full.
• Refund Confirmation – Holloway Credit Solutions, LLC may send you a text message when you receive a full or partial refund on a payment.
• Reminder of Payment Due Date – Holloway Credit Solutions, LLC may send you a text message to remind you when your payment is due. (Same as Electronic Payment Reminder)
• Return Notification – Holloway Credit Solutions, LLC may send you a text message to if your electronic check payment made online or over the phone was returned due to NSF, incorrect account number, etc.
• Scheduled Payment Cancelled – Holloway Credit Solutions, LLC may send you a text message when a future-dated scheduled payment is cancelled.
• Scheduled Payment Processed – Holloway Credit Solutions, LLC may send you a text message when a scheduled payment is processed successfully.
• Scheduled Payment Confirmation – Holloway Credit Solutions, LLC may send you a text message to confirm that a payment has been scheduled for a future date.
• Scheduled Payment Reminder – Same as Electronic Payment Reminder
• Validation Notice – Holloway Credit Solutions, LLC may send you a text message to provide you access to your Validation Information.
• Void Confirmation – Holloway Credit Solutions, LLC may send you a text message when you made a payment online or over the phone but then had that payment voided by an agent at the company.

Costs and Charges: Holloway Credit Solutions, LLC does not have a separate charge for this text message service; however, message and data rates may apply from your mobile phone carrier. Subject to the terms and conditions of your mobile phone carrier, you may receive text messages sent to your mobile phone. Participation in this text message service is standard rated (no premium content).

By providing your consent to participate in this text message service, you approve any such charges from your mobile phone carrier. Charges for text messages may appear on your mobile phone bill or be deducted from your prepaid balance.
